Terms and conditions for
online sale of in-person masterclass
1. SCOPE
1.1. These Terms and Conditions of Online Sale for in-person Masterclass (as defined below) (the “Masterclass Terms of Sale”) govern the sale via the website www.audemarspiguet.com and related subdomain websites, as well as via mobile or other digital channels (collectively, the “Platform”) of in-person Masterclasses organized in certain AP Houses, AP Labs or AP Boutiques (collectively, the “AP House”) worldwide. The list of the AP Houses offering in-person Masterclasses is available on the Platform.
1.2. Additional or alternative terms may apply depending on the jurisdiction in which the Masterclass takes place. Please refer to the jurisdiction-specific additional provisions (“Additional Provisions”) for details on such terms. In the event of any inconsistency between the Masterclass Terms of Sale and the Additional Provisions applicable to a specific jurisdiction, the Additional Provisions shall prevail.
1.3. The contract for the booking and purchase of Masterclass is concluded between the purchaser and the local subsidiary of the Audemars Piguet group that operates the AP House in which the in-person Masterclass selected by the purchaser is organized (the “Organiser”). The company name, registered seat, registration number, VAT number and contact details of each Organiser are set out in the Additional Provisions.
1.4. The Organiser may, on an exceptional basis, agree to process the booking and sale of a Masterclass directly from its AP House. In such cases, the Masterclass Terms of Sale shall apply mutatis mutandis, to the exclusion of those provisions specifically governing distance selling, which shall not apply.
1.5. The Organiser reserves the right to modify the Masterclass Terms of Sale at all times. These modifications enter into force on the publication date indicated in the Masterclass Terms of Sale, save for any Masterclass already purchased that are governed by the version of the Terms of Sale effective at the time of the purchase.
1.6. The Masterclass Terms of Sale can be displayed and saved as pdf. The purchaser can print them out.
2. MASTERCLASS DESCRIPTION AND BOOKING
2.1. The booking of a Masterclass grants the right to attend a specific in-person Masterclass organized by the Organiser. Audemars Piguet masterclasses are in-person edutainment events held on a fixed date and time, designed to introduce participants to horology in general as well as to the history of Audemars Piguet brand (the “Masterclass”). Full details of each Masterclass, including its topic, date, location, level, language, pre-requisites and price, are available on the Platform.
2.2. The types of booking available and their respective characteristics are described on the Platform. Each booking must specify the names of the participants, except for children under 16 years of age, where applicable. Bookings are nominative and may not be transferred to any person who is not duly registered.
2.3. Participation in Masterclasses is reserved for individuals aged 16 or older, unless the Masterclass is specifically designed for children.
2.4. In certain circumstances, the Organiser may be unable to process a booking request due to the application of international regulations, including sanctions.
3. PRICE, PURCHASE PROCESS AND PAYMENT
3.1. The tax-inclusive prices of the Masterclasses are quoted on the Platform in the local currency of the Organiser. The price displayed at the time of booking shall be the binding price.
3.2. To purchase one or more Masterclass(es), the purchaser must create an AP account on the Platform or, if already registered, log in to their existing AP account and complete the required fields to book a Masterclass for themselves and/or any accompanying guests. When submitting the booking request, the purchaser also confirms their acceptance of the Masterclass Terms of Sale. The selected Masterclass type and quantity, together with the information provided by the purchaser, will be displayed in an overview, which the purchaser may either accept or cancel using the designated tools. To modify the order, the purchaser must cancel the initial booking request and initiate a new one.
3.3. Upon receipt of a booking request for a Masterclass, the Organiser will send the purchaser an email containing a payment link for the total amount of the Masterclass price (payment by link). The total amount due must be paid in full within five (5) days upon receipt of the payment link. Failure to complete payment within this period will result in the cancellation of the booking. Payments must be made in the local currency of the Organiser using a credit or debit card. Payments made via the payment link are subject to separate terms and conditions, which the purchaser must accept prior to completing the transaction. Such payments are secured by an encryption system ensuring the confidentiality and security of the data transmitted.
3.4. Once the full price of the Masterclass has been paid and the transaction has been successfully completed, the purchaser will receive an email confirming the booking of the Masterclass(es), including the relevant booking details. The Organiser does not issue tickets or QR codes.
3.5. Masterclass bookings are processed within the limitation of the quotas assigned to each Masterclass.
4. VERIFICATION AND ACCESS TO THE MASTERCLASS
4.1. Access to the Masterclass is subject to the verification of the booking confirmation. For security reasons, the booking is issued in the name of the purchaser and any registered guest(s) and is non-transferable. The Organiser reserves the right to request identification documents from the purchaser and registered guest(s) to verify their identity and to refuse access to the Masterclass, without refund, if the name(s) indicated in the booking do(es) not correspond to the identity of the purchaser and/or registered guest(s). Furthermore, the Organiser is authorized to refuse access to the Masterclass, without refund, if the purchaser and/or registered guest(s) arrive more than ten (10) minutes after the scheduled start time of the Masterclass.
5. CANCELLATION POLICY
5.1. The bookings, even if unused, may not be cancelled, exchanged or reimbursed, except as expressly provided below.
5.2. The purchaser may modify or cancel their booking up to three (3) days prior to the date of the Masterclass indicated in the booking confirmation and will receive a full refund. Changes or cancellations may be made using the “manage my booking” feature available in the confirmation email or by contacting the Organiser at the telephone number or email address set out in the Additional Provisions. No refund will be issued for cancellations made less than three (3) days before the Masterclass or in case of no-show. Where applicable, any refund will be credited to the purchaser to the same debit/credit card or bank account used for the original purchase of the Masterclass, to the exclusion of all other means of reimbursement, within fifteen (15) days from the date of receipt of the purchaser’s cancellation request.
6. DATA PROTECTION
6.1. The personal data of purchasers and participants will be handled with strict confidentiality.
6.2. Audemars Piguet (Marketing) SA, route de France 16, 1348 Le Brassus, Switzerland, which manages the Platform and Audemars Piguet group’s central Client Relationship Management system, is responsible for the collection and processing of the personal data of the purchasers and the participants for the purpose of the customer relationships. The Organiser is responsible, at the local level, for the collection and processing of the participants’ personal data for the purpose of managing the bookings and the commercial and contractual relationship relating to the Masterclass and its organization. Audemars Piguet (Marketing) SA and the Organiser process the purchasers’ and participants’ personal data in compliance with the Swiss Federal Act on Data Protection, the EU General Data Protection Regulation (GDPR) and any other applicable data protection legislation. 6.3. Purchasers have the right to access, rectify and delete their personal data by submitting a request to: Audemars Piguet (Marketing) SA, Data Protection Officer, Route de France 16, 1348 Le Brassus, Switzerland or by e-mail at privacy@audemarspiguet.com. The personal data of the purchaser’s guests will be deleted after the Masterclass unless Audemars Piguet is authorized to process these personal data for another purpose.
7. LIABILITY
7.1. The liability of the Organiser or of any other Audemars Piguet group company is limited to the amount paid for the Masterclass, unless otherwise provided by mandatory applicable law. The Organiser is not liable for any travel or accommodation expenses, nor for any indirect damage.
7.2. The Organiser declines any responsibility in case a participant is requested to leave the Masterclass due to the non-respect of any rules applicable to such Masterclass. A participant who is requested to leave a Masterclass shall not be entitled to any compensation or refund of the price paid for the Masterclass.
7.3. In the unlikely event that the Organiser has to cancel the Masterclass, the purchaser shall receive a full refund of the price paid for the Masterclass. The refund will be credited to the same debit/credit card or bank account used for the original purchase, to the exclusion of any other form of compensation.
7.4. Neither the Organiser, nor any other Audemars Piguet group company shall be held liable for any damage resulting from the use of the Internet, and in particular from a service malfunction or the presence of a computer virus or other harmful material affecting computer equipment as a result of the purchaser accessing the Platform, or fraudulent communications or impersonation attempts that originate outside Audemars Piguet sphere of control and responsibility (including spoofing). The purchaser is responsible for verifying the authenticity of any communication that appears suspicious or that requests personal information or payment instructions.
8. GOVERNING LAW AND JURISDICTION
8.1. The Masterclass Terms of Sale shall be governed by and construed in accordance with the laws of the registered seat of the Organiser excluding its rules on conflict of laws. Where the laws of the registered seat of the Organiser are different to mandatory consumer protection laws in the country where the purchaser is domiciled, the Organiser will afford the purchaser with similar protection.
8.2. For any dispute arising out of or in connection with the Masterclass Terms of Sale or any breach thereof which cannot be settled by mutual agreement, the purchaser may bring proceedings either before the courts of the Organiser’s registered seat or the courts of the place where the purchaser is domiciled. The Organiser may bring proceedings against the purchaser only before the courts of the place where the purchaser is domiciled.
