オンライン決済サービス（以下「サービス」）を使用して [Audemars Piguet (Japan) Ltd] （以下「AP」）に対し、続く項で詳細に定義する返金可能な保証金を含むあらゆる支払いは、以下の利用規約（以下「規約」）に準拠するものとします。

課税対象である場合、提示価格には消費税が含まれています。

本サービスをご利用される前に、ご使用のクレジットカードに発生する追加手数料や費用について、カード発行会社（銀行等）へご確認いただくことを推奨いたします。

下記のリンクをクリックしサービスを利用する際に提供されるクレジットカード情報は、Adyen N.V.社もしくはその関連会社またはGlobal Payments Asia-Pacific (Hong Kong) 社もしくはその関連会社の決済ゲートウェイにより、各プラットフォームに提示される通り処理されますが、APには提供されずAPによってアクセスできないものとします。各記入欄に入力された情報の正確性は全て本サービスのユーザーであるお客様の責任となります。お客様は、本サービスの利用により生じ得るあらゆる争議の解決に役立つと思われる取引決済記録の控えを保管されるよう推奨します。

タイムピースのご注文は、発行銀行による支払い確認をもって双方に拘束力を持つものとします。AP は、タイムピースのお受け取りが可能となった日時について、メール、WhatsApp、その他ご希望の連絡手段にてお知らせいたします。

タイムピースの所有権は、AP が最終販売請求書を発行した時点でお客様に移転し、タイムピースの紛失・破損に関するリスクは、お客様が受領された時点で移転します。

AP は、お客様に対し受取可能の通知を行った後、合理的な期間内にお引き取りが行われなかった場合、全額返金を条件として取引をキャンセルする権利を留保します。

オーダーメイド以外で、AP が現時点で販売可能な在庫を持たないタイムピースに対してデポジットをお支払いいただく場合、以下が適用されます：

-    AP は、当該タイムピースが限定生産品であり、販売のために確保できない可能性がある旨をお客様へ説明しています。

-    AP が当該タイムピースを入手した際には、その旨をお客様へご案内します。

上記第4条に従い販売が完了するまでの間、お客様はデポジットの返金を求めることができ、AP もまた、理由の有無を問わずデポジットを返金することができます。

デポジットの支払いは、AP がタイムピースを販売する義務、またはお客様が購入する義務を構成するものではありません。

これは、該当タイムピースが販売可能となった場合に購入を希望するという、拘束力のない意思表示にすぎません。オーダーメイド品に関するデポジットは個別の条項に基づき、本条5の対象外となります。

お客様が本サービスを利用されることで発生または関連して生じた、財産の損害、損失、費用（弁護士費用を含む）、間接損失、またはあらゆる結果的損害について、AP は一切の責任を負いません。

特に、以下に起因する損害については責任を負いません：

-   インターネット環境の利用に伴う潜在的なリスク

-    サービスの不具合

-    ウイルスその他破壊的要素により機器に生じた損害

-    AP の管理範囲外から発生する詐欺的コミュニケーションやなりすまし（スプーフィング）

お客様は、不審な連絡や個人情報・支払い情報を求める連絡について、その真正性を確認する責任を負います。

本規約は、追加のサービス別規約（例：マスタークラス販売規約など、以下「追加規約」）によって補足される場合があります。追加規約が適用される場合、それらは本規約の不可分の一部となります。特定サービスに関して、本規約と追加規約の内容に矛盾が生じる場合は、当該サービスに限り追加規約が優先されます。

本規約は、AP の登録所在地の法令（法の抵触に関する規定を除く）に準拠し、これに従って解釈されます。ただし、AP 登録地の法令が購入者の居住国における消費者保護法より弱い場合、APは購入者に同等の保護を提供します。

本規約に関連して紛争が発生し、双方で解決できない場合、

-    お客様は、AP の登録所在地の裁判所、またはご自身の居住地の裁判所へ提訴できます。

-   AP は、お客様の居住地の裁判所にのみ提訴できます。

Any payment, including of refundable deposits as further defined below, made to Audemars Piguet (Japan) Ltd (“AP”) using the online payment services (“Services”) is subject to the following terms and conditions (“Terms”):

Prices quoted are inclusive of any sales taxes if applicable.

Before using the Services, it is recommended that you enquire about any additional charges or fees payable against the credit card used from credit card service provider i.e. the respective bank.

The credit card information supplied by you at the time of using the service after clicking the link below is processed either by the payment gateway of Adyen N.V. and/or its affiliates or by the payment gateway of Global Payments Asia-Pacific (Hong Kong) Ltd and/or its affiliates, as indicated on the relevant platform, and is not supplied to or accessible by AP. It is your sole responsibility as the user of the Services to ensure that the information entered in the relevant fields is correct. It is recommended that you take and retain a copy of the transaction for record keeping purposes, which might assist in resolution of any disputes that may arise out of usage of the Services.

Orders of timepieces will be binding on the parties on payment confirmation by the issuing bank. AP will confirm the date of availability of the timepiece for collection to you via email, whatsapp or any other preferred method of communication. Title to the timepiece shall be transferred to you upon issue of the final sales invoice by AP whereas risk of loss and damage to the timepiece shall pass to you when you take possession of the same.

AP reserves the right to cancel the transaction, subject to a refund of the full purchase price, in case timepieces are not claimed within a reasonable amount of time from notification of availability.

Should you make an upfront deposit payment for a timepiece which AP does not immediately have available for sale to you, except for timepieces made to order,  the following rules apply:

AP has advised you that the timepiece in question is a limited production item, and AP may not be able to obtain such timepiece for sale to you. AP will advise you if, as and when it receives such timepiece. Until the title of such timepiece has been transferred in accordance with article 4 above, you may request the return of the deposit amount or AP may refund the same to you for any reason or for no reason.

Payment of the refundable deposit does not constitute a commitment by AP to sell the timepiece to you, or a commitment by you to purchase such timepiece from AP. Rather, this payment is a non-binding expression of interest by you in purchasing the described timepiece if the same becomes available for sale by AP.

Deposit payments related to timepieces made to order are subject to specific terms and conditions and are therefore not covered by this article 5.

AP does not accept any liability for any damage to property, loss, cost        (including legal costs), expenses, indirect losses or consequential damage of any kind which may be suffered or incurred by you through the use of the Services.

In particular, AP shall not be held liable for any potential damage resulting from the use of the Internet network, and in particular from a service malfunction or the presence of a computer virus or other destructive material damaging a computer equipment as a result of you accessing AP website, or fraudulent communications or impersonation attempts that originate outside Audemars Piguet sphere of control and responsibility (spoofing). You are responsible for verifying the authenticity of any communication that appears suspicious or that requests personal information or payment instructions.

These Terms may be supplemented by additional or service-specific terms and conditions (e.g. the terms and conditions of sale of masterclass) (the “Additional Terms”). Such Additional Terms, when applicable, shall supplement and form an integral part of these Terms. In the event of any inconsistency between these Terms and the Additional Terms applicable to a specific service, the Additional Terms shall prevail solely with regard to that specific service. 

These Terms shall be governed by and construed in accordance with the laws of the registered seat of AP excluding its rules on conflict of laws. Where the laws of the registered seat of AP are different to mandatory consumer protection laws in the country where the purchaser is domiciled, AP will afford the purchaser with similar protection.  

For any dispute arising out of or in connection with these Terms or any breach thereof which cannot be settled by mutual agreement, you may bring proceedings either before the courts of AP’s registered seat or the courts of your place of domicile. AP may bring proceedings against you only before the courts of your place of domicile.
